Background information:
On April 7th, 2009, the plaintiff S.C. Vodafone Romania S.A. (Vodafone) filed a complaint with the National Authority for Management and Regulation in Communications (ANCOM) against the respondent S.C. Romtelecom S.A. (Romtelecom).
The plaintiff asked ANCOM to impose on Romtelecom the obligation to conclude, within 7 days from the resolution, respectively from the communication of the decision settling the dispute, an addendum to the existing interconnection agreement between the parties, which would establish the conditions in which Romtelecom offers the cascade billing method for the interconnection service in view of the switched transit.
During the first meeting for the resolution of the main issue, Vodafone completed its complaint with a new allegation, requiring ANCOM to verify if, by setting a EUR 370 tariff for the management of the cascade billing method, Romtelecom complied with its obligation to charge cost-oriented tariffs, as established by the provisions of art. 1 paragraph (7) of the Decision of the president of the National Regulatory Authority for Communications no. 147/2002 on the principles and prerequisites of the reference offer for interconnection with the public fixed telephony network, with the subsequent amendments and completions.
In order to resolve the complaint, the plaintiff chose the contentious procedure.
