Background:
On December 20th, 2010, the plaintiff S.C. ROMTELECOM S.A. (Romtelecom) filed a complaint with ANCOM against the respondent S.C. ATLAS TELECOM NETWORK ROMÂNIAS.R.L. (Atlas Telecom).

The plaintiff asked ANCOM to impose on Atlas Telecom the obligation to amend the Interconnection Agreement existing between the parties by the conclusion of an Addendum which would regulate the interconnection tariff for the provision of the fixed call termination service on Romtelecom’s network at the level provided for in art.2 paragraph (1) of Decision no.644/2008 on the designation of S.C. Romtelecom S.A. as a provider with significant power in the market for fixed call termination services.
