Description

On August 26, 2005, S.C. Orange Romania S.A. filed a complaint with the National Regulatory Authority for Communications, against S.C. Romtelecom S.A. thereby requiring that the respondent be obliged to establish the interconnection tariffs for the service of emergency call termination as Euro/minute, not as Euro/call, to charge the tariffs provided in the bilateral interconnection agreement for the interconnection service in view of ”112” call termination, to charge identical interconnection tariffs for emergency call termination services and for the service of call termination for additional information provided through three-digit numbers, in case of all the operators, to charge an interconnection tariff for the service of 959 call termination in proportion to the services provided to this number, as well as to cancel the invoices issued by the respondent for the interconnection services in view of emergency call termination, for the service of call termination for additional information provided through three-digit numbers and for calls to 959 within the period January-August 2005 and to issue new invoices, accordingly. The petition was registered with ANRC under no.22709/26.08.2005.

For the settlement of this dispute, the plaintiff chose the contentious procedure.

Furthermore, as a provisional measure, Orange required that the respondent be obliged to suspend the invoicing of interconnection services for the purpose of emergency call termination, for the service of call termination for additional information provided through three-digit numbers and for calls to 959, as well as that the payment obligation to the respondent for the invoices issued for the respective services be abolished. The plaintiff’s request for provisional measures has been solved by the ANRC President’s Decision no.1327/2005.
