ANCOM has adopted new rules on numbering resources and on number transfer between operators

At today’s meeting of the Consultative Council, ANCOM has adopted the decision that completes and clarifies the regulatory framework on how the providers in the electronic communications market can acquire the right to use numbering resources. A new way of transferring numbering resources has also been introduced, so that the providers’ subscribers should be affected to the least possible extent. 

The decision will be published in the Romanian Official Journal and will enter into force on the date of publication.

Main provisions

In the case of merger or reorganisation operations, the right to use the numbering resources will be taken over following ANCOM’s amending the provisions of the license to use the numbering resources held by the acquired provider. The right to use the numbering resources can be taken over by a person who has the status of a provider of public electronic communications networks or od publicly available electronic communications services.

For cases of partial division, the procedure for taking over the right to use the numbering resources remains unchanged - by transfer or assignment of the resources.

A new method of transferring the right to use numbering resources has also been established. This new procedure can only be used when the procedure for transferring numbering resources or the existing transfer procedure cannot be applied. The transfer procedure may be initiated at the request of both parties, with prior notification to ANCOM at least 30 days before the start date of the transfer implementation and based on an implementation plan.

ANCOM's measure was triggered by the increasing dynamics of reorganization operations or of other operations resulting in an economic concentration, which also have effects on the rights to use numbering resources.

Moreover, the provisions regulating number portability have been supplemented in order to explicitly provide for the right of the provider taking over the contracts for the provision of services through numbers ported in the network of a reorganized provider to continue using these numbering resources, as it substitutes itself in the rights and obligations incumbent on the reorganized provider as an accepting provider.
