Background information:
On March 12th, 2009, the plaintiff S.C. Romtelecom S.A. (Romtelecom) filed a complaint with the National Authority for Communications (ANC) against the respondent S.C. Vodafone Romania S.A. (Vodafone)
The plaintiff requested thereby to impose on the respondent the obligation to conclude an addendum to the interconnection agreement no. 204/01/5931/15.08.2006, which would establish the conditions under which the access to the network of Romtelecom for the termination on its mobile network of the calls originated in the network of Vodafone and, respectively, for the termination on the network of Vodafone of calls originated from the mobile network of Romtelecom (hereinafter the Service) is achieved.
As well, the plaintiff asked ANC to establish a 7.21 eurocents/minute (excluding VAT) tariff for the interconnection service in view of call termination on the mobile network of Romtelecom. The complaint was registered with ANC under no.SC-8069/12.03.2009.
Furthermore, Romtelecom requested to impose on the respondent, as a provisional measure, the obligation to maintain the access to its network for the provision of the Service until the resolution of the main issue of the dispute by decision of the Authority’s president.
In order to resolve the complaint, the plaintiff chose the contentious procedure.
The respondent’s request to impose provisional measures was settled by the ANCOM President’s Decision no.198/2009.
On April 16th, 2009, the plaintiff renounced at the complaint filed against Vodafone.
