
More than 4.200 control actions and sanctions amounting over 2,5 million lei in the telecom sector sanctions

In 2024, ANCOM carried out 4.241 control actions to ensure the enforcement and compliance with the legislation and regulations in the field of electronic communications and postal services., imposed by the Authority to promote competition and to protect the users ‘rights and interests. Following these control actions, ANCOM issued 103 notifications and applied 825 warnings and 490 contravention and administrative fines, amounting LEI 2.577.500. This amount is revenue to the state budget.
Electronic communications market
In 2024, ANCOM conducted 2.350 control actions in the electronic communications market, issuing 103 notifications, 211 warnings and 159 fines amounting LEI 1.073.000.
The Authority applied 83 contravention fines amounting LEI 757.500 to telephone service providers. Most fines were applied for failure to comply with the roaming regulation, for breaching the obligations regarding the conclusion of contracts with end-users, for deficiencies in the porting process, for transmission of unilateral notification following the modification of contracts concluded with end-users. The highest fine amounting LEI 40.000 was applied for failure to comply with the roaming regulation.
ANCOM applied 1 contravention fine amounting LEI 35.000 to an internet service provider for providing electronic communications services without a valid contract concluded with the subscriber in accordance with the legal provisions.
3 contravention fines amounting LEI 20.000 were also applied to the providers of radio and TV broadcasting (RTV), mainly for non-compliance with the technical data, parameters or conditions contained in the technical authorisations.
CATV network providers were sanctioned with 21 contravention fines amounting LEI 134.000, mainly for non-compliance with the conditions stipulated in the general authorisation regime. The highest fine applied in this sector was LEI 10.000.
In the field of radiocommunications (RC), ANCOM applied 5 contraventions amounting LEI 75.000 for the use of frequencies without a valid licence or for non-compliance with the technical and operational parameters of the radio stations. The highest fine, i.e. LEI 50.000 was applied for producing harmful interference to a radiocommunication service authorized according to the law, for which radio protection must be ensured.
Radio Equipment and Electromagnetic Compatibility Market
In the radio equipment and electromagnetic compatibility market, ANCOM carried out 1,299 controls, applying 410 warnings and 239 contravention fines totaling LEI 894.000. The highest fine amounted LEI 22.500 and was imposed on a distributor for placing on the market radio equipment without applying the CE marking, in violation of compliance requirements.
In the field of electromagnetic compatibility, the largest fine, in the amount of 7,000 lei, was applied to a manufacturer for non-compliance with the obligation to display the CE marking.
Postal services market
On the postal services market, ANCOM carried out 592 control actions in 2024, following which 204 warnings and 92 contravention fines were applied, amounting to LEI 610.500. The most frequently found breach concerned the non-compliance with the obligations imposed by the general authorization regime, the highest fine, i.e. LEI 25.000, being applied for non-compliance with the content of postal notices.
3 control actions of the total targeted the Romanian Post National Company (CNPR), in its capacity as universal service provider. Following the control actions, ANCOM applied 2 warnings and 1 fine in the amount of LEI 30.000. The main breaches found were failure to comply with the choice of delivery of the postal items to the addressee, non-compliance with the requirements regarding the data on the delivery notice cards, failure to observe the requirements, non-provision of postal services and failure to mark/label the postal items.
