Relevant authorities
The relevant authorities are public institutions or authorities entrusted with the supervision of a specific sector or area of activity, or judicial authorities in the context of actions, activities or proceedings carried out by them in accordance with the legal provisions in force, which, on the basis of the applicable Union law or national law in compliance with Union law, may require the providers of intermediary services, by order, to:
- act against one or more specific items of illegal content;
- provide specific information about one or more specific individual recipients of the service;
- restore the content under applicable Union or national law, where the removed content complies with the intermediary service provider's terms and conditions but has been wrongly considered illegal by that provider and removed.
Law no.50/2024 lay down the requisite measures for the proper application of Digital Services Act and set the sanctioning regime applicable for failure to comply with the obligations under the Regulation or under the law.
Article 2 of Law no. 50/2024 In the application of the present law, the following principles shall be observed: a) the effective and efficient cooperation of all the public authorities and institutions which have attributions in specific sectors or domains of activity, at the request of the digital services coordinator, in view of application of the Regulation; b) the relevant authorities shall rule on the illegal content existing online.

According to Law no. 50/2024, ANCOM and the relevant authorities that impose measures in accordance with the national legislation on the basis of which they operate may conclude collaboration agreements thus ensuring the exchange of data and/or information resulting for and from the application of the Regulation.
Furthermore, the public institutions or authorities may provide each other with the data and/or information they hold and may consult each other.
ANCOM, as the Digital Services Coordinator, has the right to request collaboration of other authorities or public institutions holding specialized expertise, including by making available the knowledge and technical ressources necessary for the apllication of Digital Services Act and Law no. 50/2024.
As well, ANCOM has the right to request from any relevant authority the provision of information or data regarding the cases in which measures have been applied in accordance with the provisions of the Regulation or in accordance with the applicable national legislation.
