Recommendations on electronic communications networks interconnection for fixed and mobile call termination

The National Authority for Management and Regulation in Communications of Romania (ANCOM) has launched a public consultation on the Guidelines on the conclusion of interconnection agreements, a document meant to facilitate negotiations between providers of public electronic communications networks for voice call termination services provided at fixed and mobile locations.

The beginning of 2024 marked the entry into force of ANCOM's decision that drove to withdrawing all obligations imposed, at national level, on operators identified with significant power in the relevant markets corresponding to voice call termination services provided at fixed, respectively at mobile locations, on public telephone networks.

When certain obligations imposed on providers with significant power are withdrawn, the operators who have the status of buyers and are affected by these measures need to be aware of these market changes well in advance. Therefore, ANCOM has established a transitional period of one year from the date of entry into force of the decision. During this period, which ended on 18 March 2025, the previously imposed specific obligations were maintained under the same conditions.

In order to support the continuity of interconnection efforts and to ensure transparency and efficient competition on the market, ANCOM has developed these guidelines, which provide best practice recommendations on concluding interconnection agreements.

The Guidelines provide essential recommendations on the transparency of interconnection information, technical and economic conditions, the negotiation of agreements and the role of ANCOM.

ANCOM will continue to monitor the interconnection agreements concluded between electronic communications network providers, to ensure that the interconnection mechanism works effectively in this market even in the context of removing ex-ante regulations. To this end, providers have the obligation to submit copies of interconnection agreements to ANCOM starting with 18 March 2025.

Public consultation process

The Guidelines on the conclusion of interconnection agreements for the provision of voice termination services at fixed/mobile locations are available, in Romanian, here. Interested persons are invited to submit comments and suggestions until 05 May 2025, at the ANCOM's headquarters (2 Delea Noua Street, 3rd District, Bucharest), through the Online Registry or by means of the regional divisions of the Authority. Comments can also be sent by fax to +40 372 845 402 or by e-mail to consultare@ancom.ro.
