Background:
On August 10th, 2011, the plaintiff S.C. ROMTELECOM S.A. (Romtelecom) filed a complaint with ANCOM against the respondent S.C. INES GROUP S.R.L. (Ines Group).
The plaintiff thereby asked ANCOM to assess the breach of the obligation laid down in Article 23 of Law no. 304/2003 on the universal service and users’ rights relating to the electronic communications networks and services, republished, as well as to impose on the respondent the obligation to make available to Romtelecom, in its capacity as a provider of directory enquiry services, all the relevant information concerning the subscribers of Ines Group, within 10 working days from the communication of the decision resolving the dispute, on fair, objective, cost-oriented and non-discriminatory terms and without prejudice to the provisions of Article 11 of Law no. 506/2004 concerning the processing of personal data and the protection of privacy in the electronic communications sector, with the subsequent amendments and completions, currently amended and completed after the entry into force of the Government Emergency Ordinance no.13/2012.
On the date of the dispute resolution, Law no. 304/2003 was being expressly repealed by Government Emergency Ordinance no. 111/2011 on electronic communications, approved, with amendments and completions, by Law no. 140/2012.
